What is the Freedom of Information Act?

The Freedom of Information Act (FOIA) gives you access to the information held by government and other public bodies and their agents. The Act applies to information held by Newark and Sherwood Homes because we are an agent of Newark and Sherwood District Council. This Act makes it easier for you to find out about the issues that matter to you.

An independent appeals process backs up the Freedom of Information Act. The Information Commissioner (ICO) has responsibility for ensuring that public bodies comply with the legislation and will investigate complaints, if asked to do so, when a request for information under the FOIA has been refused.

What Information is Covered by the Act?

The Freedom of Information Act applies to all recorded information held by, or on behalf of a public authority. There are exemptions to the Act, but there is also a presumption in favour of disclosure. We will meet your request unless there is good reason within the Act not to in which case this will be clearly explained to you.  Further details of information available can be found in our Publication Scheme.


There are a number of exemptions to the Act. If an exemption applies then we may not have to supply the information. A full list of exemptions and further guidance is available from the Information Commissioners Office. Just because an exemption could apply, does not mean that it should apply. All decisions must be made on a case-by-case basis.

How do I make a request?

Making a request under the Freedom of Information Act is easy, by law all you have to do is:

  • Make your request in writing (either by letter to the address at the top of the page or by email to  This e-mail address is being protected from spambots. You need JavaScript enabled to view it )
  • State clearly what information is required
  • State your name and an address for correspondence

You do not have to say why you want the information.

It is helpful to say how you want the information to be sent to you, for example by email, a photocopy or printout, or you want to inspect the record in person. You do not have to refer to the Freedom of Information Act for your request to be valid, but it is useful to do so.

We have a 20 working-day deadline to respond to requests but we aim to respond sooner if possible.

Ask for Assistance

Under the Freedom of Information Act, we have a duty to provide reasonable advice and assistance to anyone wanting to make a request. Therefore you can ask for help in specifying the information you need or defining your topic, for example. You can also ask for assistance if you have a disability that prevents you from making a written request.
